Pre-Legal Collection

Managing Contact and an Agreement before Legal action

A cost effective and flexible process that reconciles well with our Facilitator Letter process or phase 1. We would recommend this service is used where litigation action is not the first course of action you want to pursue.

Pre–Legal collections or phase 2, can be the fastest form of debt recovery, the initial contact made with your Customer / Debtor at the outset maybe critical to obtaining immediate payment or negotiating a settlement.

Pre-Legal collections is often provided on a no win no fee basis, we use our knowledge and experience as Debt Recovery Lawyers, to attempt to recover the monies owed without issuing legal proceedings, aimed at saving you money from the outset with a large proportion of our fees being charged as an agreed percentage of the total debt recovered.

Our multi-skilled team are experienced in negotiation and collection techniques. We can judge the most effective course of action incorporating a combination of letters offering multiple payment methods, outbound telephone calls, SMS text and E-mails, as a reminder that the debt is now overdue and encouraging payment, which is driven by our sophisticated Case Management System (CMS).

Depending on the strategy, we will look to negotiate repayment arrangements whether by lump sum or by instalments. We monitor all arrangements during the full life of the account including Individual Voluntary Arrangements (IVA) or Bankruptcies. Our processes are set to check for missed payments and chase appropriately, automated to review instalment arrangements bi-annually.

We can target specific’s through our vast library of letters whether a Customer / Debtor is employed, has an asset or any other criteria.

Our CMS utilises a catalogue of flexible and versatile collection workflow strategies. These can be set to operate over seven, fourteen, thirty days or up to six months. However, unlike Debt Collection Agencies (DCA’s), once we have exhausted this process, we can escalate it to our Legal Team for a more robust approach.

This is an ideal approach to use where you have an ongoing business relationship with the Customer / Debtor, and it is a relationship that you wish to retain. Our library of workflows is subject to regular review to take account of sector and legal developments.
