Issuing a county court claim on your behalf
In the event there has been no response to a Letter of Claim, should you be an Individual / Company / Business of “principle”, upon your instructions, our Legal Team, will issue a county court claim on your behalf. Please note that any Fixed Fees & Disbursements agreed between us would need to be borne by you.
However, we would only recommend issuing County Court Proceedings if the principle debt exceeds £250.00. This rationale is based on our experiences that it would be uneconomical for you to purse the Defendant, taking into consideration the additional costs and disbursements that you would have to pay on account from issuing proceedings, through to obtaining Judgment for Claimant (in default), followed by enforcement as only some of these additional costs can be re-claimed from the Defendant.
There are two factors which need to be considered depending on the complexity of the claim to be issued and the Particulars of Claim in support of the claim. Firstly, it will either be issued via Money Claims Online (M.C.O.L.) or secondly, via the Northampton County Court Money Claims Centre (C.C.M.C.C.), based in Salford, Manchester. If a claim is undefended, the likely timescale from issuing County Court Proceedings to obtaining Judgment for Claimant (in default) is approximately 6 - 8 weeks.

The Fixed Fees, Fixed Costs and Disbursements you will incur depending on the level of the Principle Debt outstanding, together with any contractual / statutory interest and compensation (if applicable) interest and charges are set out in the table on the reverse of this card.
If the matter becomes defended, we will advise you on the prospects of success and an estimate of the likely costs / disbursements that you will incur, should the matter proceed through to a full Trial.
Defended Proceedings
Please note that if you are successful in obtaining Judgment against the Defendant together with the associated costs and disbursements incurred, you are only likely to receive a proportion of what you are seeking to claim, which is usually 65% - 70%.
